Terms of Service

These Terms form a binding agreement between you and [REGISTERED LEGAL NAME], a company registered in Belgium under enterprise number BE [0XXX.XXX.XXX], with registered office at [ADDRESS] ("Hostmizer", "we", "us"). By accessing this Site or using the Hostmizer® services, you accept these Terms. If you do not accept them, do not use the services.

Definitions

  • Site — hostmizer.com and its subpages.
  • Services — the Hostmizer® co-hosting and management services described in Part B, and the free tools.
  • Host — an owner or authorised manager of a property who uses the Services.
  • Guest — a person who books a Host's property, including via Stay Hostmizer®.
  • Listing — a property published through the Services.

Part A — Website Terms of Use

A.1 Use of the Site

You may use the Site only for lawful purposes. You may not: break any law; infringe anyone's rights; introduce malware; attempt to gain unauthorised access; scrape or harvest data; or interfere with the Site's operation.

A.2 Accounts

You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for all activity under your account. Notify us immediately of any unauthorised use.

A.3 Intellectual property

The Site and its content (including the Hostmizer® and Stay Hostmizer® marks, text, graphics, and software) are owned by us or our licensors. We grant you a limited, revocable, non-transferable licence to use the Site to access the Services. You retain ownership of content you upload (e.g. listing photos and descriptions) and grant us a licence to host, adapt and distribute it across booking channels solely to provide the Services.

A.4 Free tools and estimates

The revenue estimate, listing audit and regulations checker are provided for general information only. Outputs are indicative estimates prepared on the basis of the information you submit and available market data — they are not financial, tax, legal or investment advice, and not a guarantee of any result. You should obtain professional advice before relying on them.

A.5 Third-party links and platforms

The Site links to third-party platforms (e.g. Airbnb, Booking.com). We are not responsible for their content, terms or availability. Your use of those platforms is governed by their own terms.

Part B — Service Terms (Terms of Sale)

B.1 What the Services are — and are not

Hostmizer® provides digital co-hosting and management for short-term and mid-term rental Hosts. Depending on your plan, this may include: multi-channel listing and distribution; expert-led dynamic pricing; calendar synchronisation; guest communication and inquiry handling; guest verification and screening; deposit and damage-protection administration; review and reputation management; dispute mediation between Host and Guest; payment collection and payout; reporting; and access to a Host dashboard and a named listing manager.

The Services do not include on-site physical operations such as cleaning, key handover, maintenance, in-person check-in/out, or troubleshooting during a Guest's stay, unless expressly agreed in writing. You remain responsible for arranging those, whether yourself or via a partner.

B.2 Host obligations and eligibility

You confirm that you are authorised to list and rent each property you connect, and that you will keep the Listing accurate. You are solely responsible for legal compliance for each property, including:

  • short-term-rental registration, permits and licences in the relevant municipality/region;
  • any caps on rental nights, zoning or co-ownership (HOA/syndic) restrictions;
  • tourist taxes, VAT and income-tax obligations;
  • safety, insurance and guest-reporting requirements.

We may provide general information (e.g. via the regulations checker), but that is not legal advice, and compliance remains your responsibility. We may suspend or remove a Listing that appears non-compliant.

B.3 Fees and commission

Hostmizer® charges a performance-based commission on bookings generated through the Services, with [no setup fee and no fixed-term lock-in]. The applicable rate is shown during signup and in your account, and forms part of these Terms. Amounts are in EUR. [State whether prices are inclusive or exclusive of VAT, and the VAT treatment for consumers vs businesses.]

B.4 Payments, payouts and deposits

Where the Services include payment handling, Guest payments are collected through [LICENSED PAYMENT PROVIDER], and your earnings are paid out to your nominated account on a [monthly / agreed] schedule, accompanied by a statement showing bookings, fees and deductions. We administer security deposits and damage claims as described in your plan.

B.5 No guarantee of performance or earnings

Revenue, occupancy and rate improvements depend on many factors outside our control (location, seasonality, market demand, property condition, your pricing rules, and platform algorithms). We do not guarantee any specific revenue, occupancy, ranking or booking outcome. Any figures, ranges, comparisons or estimates we share are illustrative only and are not a contractual commitment.

B.6 Guest verification, protection and disputes

We apply screening to help reduce risk, administer deposits, and assist with damage claims and Host–Guest disputes as a mediator. Verification reduces but does not eliminate risk, and protection/insurance is subject to the terms, limits and exclusions of the relevant deposit scheme, platform programme (e.g. AirCover) or third-party insurer. We are not an insurer and do not underwrite damage cover ourselves [unless stated].

B.7 Term, cancellation and consumer right of withdrawal

You may cancel at any time, with [NOTICE PERIOD / effective at the end of the current cycle]. Commissions on bookings already made remain due.

B.8 Suspension and termination by us

We may suspend or terminate access if you materially breach these Terms, fail to pay, or use the Services unlawfully. We will give notice where reasonably possible. On termination we will reconcile outstanding amounts and assist with an orderly wind-down of active bookings.

B.9 Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost bookings or lost data. Our total aggregate liability for any claim is limited to the fees you paid to us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law (including liability for fraud, gross negligence, death or personal injury, or mandatory consumer rights).

B.10 Indemnity

You will indemnify us against claims arising from your breach of these Terms, your unlawful or non-compliant operation of a property, or content you provide that infringes a third party's rights — except to the extent caused by us. [For consumer Hosts, counsel should confirm this clause is enforceable and appropriately limited.]

B.11 Changes to the Services and Terms

We may modify the Services and update these Terms. For material changes we will give reasonable notice; continued use after the change takes effect constitutes acceptance. [For consumers, give advance notice and a right to terminate without penalty before changes take effect.]

B.12 Stay Hostmizer® (guest bookings)

Bookings made by Guests on Stay Hostmizer® are additionally governed by separate Guest Booking Terms.

Governing law and dispute resolution

These Terms are governed by Belgian law. Subject to mandatory consumer rules, disputes will be brought before the competent courts of [JUDICIAL DISTRICT], Belgium.

For consumers: before going to court, you may use alternative dispute resolution.
