What rules apply to short-term rentals in Florida?
DBPR state licence, state and county taxes, and local rules.
Florida Statute 509.242 defines a “vacation rental” as a unit in a condominium or cooperative, or a single-, two-, three- or four-family house or dwelling unit, rented as transient public lodging (timeshares excluded). A vacation rental must hold a state licence from the Florida Department of Business and Professional Regulation (DBPR) before it operates; apply at the DBPR.
Taxes: the statewide 6% sales tax applies to stays of six months or less; counties add a tourist development tax of 1% to 6%; combined state, county and local taxes often total 10% to 13%. Platforms collect the state-level tax; the county tax is often still the host’s job and varies by county (Seminole: platforms remit for platform bookings, hosts for direct bookings; Santa Rosa and Flagler: hosts register and remit directly). Check your county’s official page for the current rules.
Local rules: state law says cities and counties may not prohibit vacation rentals or regulate the duration or frequency of stays, unless their rules predate 1 June 2011; they can regulate registration, inspections, occupancy, parking, signage and noise. Examples: Miami Beach uses zoning and requires a Business Tax Receipt; Orlando allows home-sharing with conditions including that the host lives on site; Fort Lauderdale requires a noise-level detection device. Check your city’s official page before you list.
No national rule. Short-term rental rules are set by the state, the county and the city, and they differ a lot: a licence or registration in many cities, hotel/occupancy/“transient” taxes at state and local level, primary-residence-only rules in some cities, zoning limits, and condo or HOA rules that can forbid rentals altogether. The three things to check before you list: (1) does your city or county require a licence or registration number, (2) which taxes apply and who collects them (platforms often collect the state tax, but the local tax and the filings are often still yours, and direct bookings always are), (3) does your building, HOA or lease allow it.
